The Liberty Protection Safeguards (LPS) were due to be implemented in April 2022. Following several delays, the government announcement of a much longer-term delay has left many people in social care feeling uncertain and wondering what to do next.
This Q and A webinar will provide an opportunity to engage with Alex Ruck Keene of 39 Essex Chambers to consider the implications of the delay and how we can redirect our learning and efforts in preparing for LPS to move forward in the current legislative context.

Liberty Protection Safeguards: What are the implications of the delay?
In April, the government announced that implementation of the Liberty Protection Safeguards (LPS) would be delayed ‘beyond the life of this Parliament’. In this blog, Alex Ruck Keene outlines the implications of this delay.
Legal literacy
Legal literacy is the ability to connect relevant legal rules with professional priorities and objectives of ethical practice. The legal literacy resources will support practitioners, supervisors and strategic leaders to feel confident in their legal literacy knowledge and in their decision-making.
Mental capacity
Mental capacity refers to a person’s ability to understand and retain information and to weigh this information up to make a decision. The Mental Capacity Act 2005 sets out people’s rights in relation to decision making, as well as the responsibilities of people supporting those who lack capacity. The act requires that any decisions made on another person’s behalf are the least restrictive of their rights and freedoms, are in their best interests and take account of their feelings.
